DMCA PROVISIONS

The Digital Millennium Copyright Act of 1998, found at 17 U.S.C. § 512 ("DMCA"), provides recourse for owners of copyrighted materials who believe that their rights under United States copyright law have been infringed upon.. Under the DMCA, the bona fide owner of copyrighted materials who has a good faith belief that their copyright has been infringed may contact the person or entity infringing on their copyright.

DMCA NOTICE

If you believe that material available on inkuitive.com infringes on your copyright(s), please notify us by submitting a DMCA notice. After receiving a valid and complete notice, we will investigate, remove the material, and make a good faith attempt to contact the artist or artists who provided us with the materials in question.

If you are not sure whether material located on Inktuitive’s website infringes on your copyright, or if it is subject to fair use protections, you should first consider seeking legal advice.

You may be liable for damages (including costs and attorneys’ fees) if you materially misrepresent that material or activity infringes on your copyright. 

COUNTER NOTIFICATION TO CLAIMED COPYRIGHT INFRINGEMENT

Any artist who believes in good faith that a notice of copyright infringement has wrongfully been filed against them, may submit a Counter notice to Inktuitive.

If Inktuitive receives a valid counternotification, the DMCA provides that the removed or blocked information will be restored or access re-enabled. Inktuitive, at its discretion, will replace the removed material and cease disabling access to it in not less than 10, nor more than 14, business days following receipt of the counternotification, unless Inktuitive first receives notice from the complaining party that such complaining party has filed an action seeking a court order to restrain the alleged infringer from engaging in infringing activity relating to the material on this website.

Please be advised that United States copyright law provides substantial penalties for a false counternotice filed in response to a notice of copyright infringement.
